If a PAN is not linked with Aadhaar on or before June 30, 2023, then the status of such a PAN is considered inoperative as per the Income-tax Act, 1961.

We will be unable to process any transactions in folios where the status of the PAN as per NSDL records is Inoperative. Further, the KRAs also check the status of PAN and if found inoperative, then the KYC status is also put on hold until compliance with the above requirement is met.
An investor’s tax status of being a non-resident may not be updated in the records of the Income Tax department. This will consequently have a direct impact on the PAN-Aadhaar linking requirement.

Resolving the inoperative PAN issue
To address the inoperative PAN issue, the IT department has outlined specific formalities for NRIs. You need to provide supporting documents, including a copy of your PAN card and passport, to demonstrate your residential status and period. This documentation will facilitate the IT department in updating your residential status in the PAN database.
Individuals for whom it is not mandatory to obtain an Aadhaar (NRIs and OCIs living abroad) must do the following:
Option I
- Visit your Income Tax e-filing portal.
- Visit “My Profile” Section
- Under contact details change your Residential status to Non-Resident
Option II
- Use the email ID of the relevant tax jurisdiction found on the IT portal, and send an email to the IT officer, attaching your passport copy and documents supporting your past stay in India.
- Wait for the tax department to update your status.
- Once done, notify the Assessing Officer that PAN-Aadhaar linking is no longer necessary, and they will reactivate your PAN.
Option III
- Apply for an Aadhaar Card
- While you are not obliged to obtain an Aadhaar, you can choose this route to revive your PAN.
- You must visit an Aadhaar Kendra in India. Online application is not available; you can only schedule an appointment online, but you must be physically present for biometrics.
